INDEMNITY & GRIEVANCES

1. Acknowledgment of Risks and Assumption of Responsibility
I hereby confirm that I am fully aware of the inherent risks, dangers, and hazards involved in visiting and participating in activities at SkyTrek Adventure's campsites or adventure parks. These Adventure Activities include, but are not limited to:

• Use of zip lines, suspended bridges, ladders, rope swings, cable swings, and nets.
• Travel within or beyond designated boundaries, including on trails.
• Orientation and instructional courses.
• Archery, axe throwing, and other related activities.

I understand that these risks may include, but are not limited to: exposed natural objects (rock, earth, ice, trees, branches), travel on un-assumed roads or rough terrain, negligence of other participants, changing weather conditions, equipment failure, improper use of equipment, falls, over-exertion, and collisions.

I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS, AND HAZARDS, INCLUDING NEGLIGENCE ON THE PART OF THE RELEASEES.

2. Release of Liability, Waiver of Claims, and Indemnity Agreement
In consideration of the Releasees allowing my participation in Adventure Activities and the use of their services, equipment, and facilities, I agree as follows:

• TO WAIVE ANY AND ALL CLAIMS I have or may have in the future against the Releasees.
• TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense, or injury (including death) that I or my next of kin may suffer as a result of my participation in Adventure Activities, due to any cause whatsoever. This includes negligence, breach of contract, or breach of any statutory or other duty of care (including under the Occupiers' Liability Act, R.S.O. 199106), even if the Releasees failed to take reasonable steps to protect me from the aforementioned risks.
• TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for property damage, loss, or personal injury to any third party resulting from my participation in Adventure Activities

I understand that this Release Agreement is effective and binding upon my heirs, next of kin, executors, administrators, assigns, and representatives in the event of my death or incapacity.

3. Jurisdiction
This Release Agreement and any related rights, duties, and obligations shall be governed by and interpreted solely in accordance with the laws of the State of Rajasthan, India. Any litigation involving the parties to this Release Agreement shall be brought solely within the State of Rajasthan and shall be under the exclusive jurisdiction of the Courts of Udaipur.

4. Health and Safety Compliance
I affirm that I am in good physical and mental health and do not suffer from any handicaps or medical conditions that would endanger myself or others as a result of participating in these activities. I understand that these activities place unusual mental and physical stress on the body and are not recommended for individuals with conditions such as asthma, epilepsy, cardio/respiratory disorders, hypertension, skeletal/joint/ligament conditions, cardiac or pulmonary conditions, high blood pressure, neurological disorders, chronic neck or back problems, or a history of aneurysms.
I understand that the unlawful possession, use, distribution, or dispensation of a controlled substance or illegal drug, or participation under their influence, is strictly prohibited at SkyTrek Adventure sites. Any such violation will automatically release SkyTrek Adventure from any claim for compensation.
I agree to be fitted into a sit harness, chest harness, and helmet, and to attend a demonstration and practice session. I will be made aware of proper riding techniques, equipment use, and safety rules. I acknowledge that I will be exposed to heights on platforms. I commit to following all rules and safety procedures and obeying the instructions of the guides at all times.

5. Data Privacy and Additional Conditions
I understand that SkyTrek Adventure does not sell my information or provide it to third parties outside of its organization and affiliate companies.
In addition to this Release Agreement, I understand and agree:

• To be bound by all of SkyTrek Adventure's registration conditions.
• To familiarize myself with SkyTrek Adventure's activity safety guidelines.
• To inform SkyTrek Adventure of any medical conditions that might affect my participation.
• That any medical costs arising from my participation at SkyTrek Adventure are my sole responsibility.

6. Declaration and Digital Consent
I confirm that I have read and fully understood this entire Release Agreement prior to digitally signing it. I am aware that by clicking the checkbox on the website, I am digitally signing this form and waiving certain legal rights that I, my heirs, next of kin, executors, administrators, assigns, and representatives may have against the Releasees.

I submit this indemnity bond with full consciousness, and my digital signature (by clicking the checkbox) shall be considered my original signature and treated as authentic and valid consent. I am also signing this indemnify bond on behalf of all members, organization or family members visiting any of the SkyTrek Adventure's associated premises, areas or vicinity wherever such activities are conducted by SkyTrek Adventure or any of its associates or partners and I have taken their consent & agreement regarding the same.”
